Terms of service
§ 1 – Scope
These Terms and Conditions apply to all orders placed by consumers and businesses ("Customers") through the online shop at www.viraxe.com operated by Viraxe Labs GmbH ("Provider").
The Provider ships exclusively to Austria, Germany, France and Italy. Orders from other countries cannot be processed.
The version of these Terms and Conditions valid at the time of placing the order shall apply. Deviating terms of the Customer shall not be recognized unless the Provider expressly agrees to their validity in writing.
§ 2 – Conclusion of Contract
The presentation of products in the online shop does not constitute a legally binding offer but rather a non-binding invitation to the Customer to order goods (invitatio ad offerendum).
By submitting an order, the Customer makes a binding offer to purchase the goods contained in the shopping cart. The confirmation of receipt of the order by email does not yet constitute acceptance of the offer.
The contract is concluded only when the Provider ships the ordered goods to the Customer and confirms the shipment by email (shipping confirmation) or expressly accepts the order (order confirmation).
By way of exception, for subscriptions the contract is concluded upon completion of the checkout process (see § 13).
§ 3 – Prices and Payment
All prices stated in the online shop are final prices including the applicable statutory value-added tax. Additional delivery and shipping costs are displayed separately before completion of the order.
The payment methods displayed during checkout are available (including credit card, PayPal, Apple Pay, Google Pay, Klarna, EPS, Shop Pay).
Payment is due immediately upon completion of the order. For subscriptions, the charge is processed at the time of ordering and thereafter on each billing date in accordance with § 13.
§ 4 – Delivery and Shipping
Delivery is made to the delivery address specified by the Customer. Further details are set out in our Shipping Policy at www.viraxe.com/policies/shipping-policy.
Estimated delivery times are:
- Austria and Germany: 2–3 business days
- France and Italy: 4–6 business days
The stated delivery times apply from the date of shipment. Shipping is handled by our fulfillment partner emoro.at (M&M Handels GmbH, Heuweg 10, 8041 Graz, Austria).
§ 5 – Retention of Title
The delivered goods remain the property of the Provider until the purchase price has been paid in full.
§ 6 – Right of Withdrawal
Consumers are entitled to a statutory right of withdrawal pursuant to the Austrian Distance and Off-Premises Contracts Act (FAGG). The detailed withdrawal instructions and the model withdrawal form can be found in a separate document and at www.viraxe.com/policies/refund-policy.
In addition, the Provider grants a voluntary Satisfaction Guarantee of up to 90 days in accordance with § 7.
§ 7 – Voluntary Satisfaction Guarantee (up to 90 days)
In addition to the statutory warranty and withdrawal rights, the Provider voluntarily grants a Satisfaction Guarantee. The consumer’s statutory rights, in particular the right of withdrawal under § 6, remain unaffected and are not limited by this guarantee.
Scope. The guarantee applies to first-time buyers and only to their first order of Viraxe Deepwork via www.viraxe.com. It may be claimed once per person and per household. It does not apply to subsequent subscription deliveries (renewals) or to a later change of plan. Wholesale, reseller and B2B orders are excluded.
Guarantee period. The period depends on the plan chosen in the first order and begins on the day of receipt of the goods: 90-day plan (3 tins): 90 days. 30-day plan (1 tin) and one-time purchase (1 tin): 30 days.
Conditions. The claim must be made within the guarantee period by email to office@viraxe.com, stating the order number; to meet the deadline it is sufficient that the email is sent within this period. The extent to which the product has been consumed is irrelevant – the guarantee also applies if all tins are empty. No return of the goods is required.
Refund. Within 14 days of our confirmation of the claim, the Provider refunds the full purchase price of the first order (all tins contained in it) including standard delivery costs to the original payment method. Free gifts (7-Day Case, Focus Guide) remain with the customer.
Subscription. If the guarantee is claimed, the subscription ends with the refund. Subsequent deliveries already shipped and billed are not refunded.
Abuse. The Provider reserves the right to refuse a claim where there are concrete indications of abusive or repeated use of the guarantee, in particular in the case of multiple or serial sign-ups. No claim exists beyond the terms set out above.
§ 8 – Warranty
The statutory warranty provisions under Sections 922 et seq. of the Austrian General Civil Code (ABGB) apply. The warranty period for consumers is two years from delivery of the goods. In the event of a defect, the Customer is primarily entitled to repair or replacement. If neither is possible or reasonable, the Customer may claim a price reduction or rescission of the contract.
§ 9 – Liability
The Provider is liable without limitation for intent and gross negligence as well as for damage resulting from injury to life, body or health. In the case of slight negligence, the Provider is liable to consumers in accordance with the statutory provisions.
The Provider points out that dietary supplements are not a substitute for a varied and balanced diet and a healthy lifestyle. The recommended daily intake must not be exceeded. Products must be stored out of the reach of children.
§ 10 – Data Protection

§ 11 – Applicable Law and Jurisdiction
Austrian law shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If the Customer is a consumer domiciled in the EU, the mandatory provisions of the law of the state in which the consumer has their habitual residence shall remain unaffected (Article 6(2) of the Rome I Regulation).
For disputes with businesses, the competent court at the Provider's registered office (Wels, Austria) shall have jurisdiction. For consumers, the statutory jurisdiction provisions apply, in particular the jurisdiction of the consumer's domicile or habitual residence.
§ 12 – Severability Clause
Should individual provisions of these Terms and Conditions be or become invalid or unenforceable, this shall not affect the validity of the remaining provisions. The invalid or unenforceable provision shall be replaced by a valid and enforceable provision that comes closest to the economic purpose of the original provision.
§ 13 – Subscription (Deepwork Subscription)
1. Subject Matter
With the Deepwork subscription you enter into a contract for the recurring delivery of Viraxe Deepwork. Two plans are available: the 30-day plan (1 bottle, delivered every 4 weeks) and the 90-day plan (3 bottles, delivered every 90 days). The contract is concluded upon completion of the checkout process (clicking “Buy now”); the order confirmation email constitutes acceptance.
2. Term and Cancellation
The subscription runs for an indefinite period and can be cancelled at any time with effect for the next delivery that has not yet been billed – in your customer account under “My subscription”, by email to office@viraxe.com or via the “Cancel contracts here” button on www.viraxe.com. The right to extraordinary termination for good cause, the statutory right of withdrawal and the Satisfaction Guarantee (§ 7) remain unaffected.
3. Prices and Billing
The 30-day plan costs €42.90 per delivery, the 90-day plan €99.90 per delivery, in each case including VAT and shipping within the delivery area. The amount is charged automatically to your stored payment method on the day of the order and thereafter on each billing date (every 4 weeks or every 90 days, depending on your plan). You ensure that the payment method is valid and has sufficient funds; you can change it at any time in your customer account. If a charge cannot be processed, we will inform you by email; delivery takes place only after successful payment.
4. Free Gifts
With the first delivery of your subscription you receive free welcome gifts: on the 90-day plan the Signature Edition 7-Day Case and the digital Viraxe Focus Guide, on the 30-day plan the digital Viraxe Focus Guide. The gifts are part of the first delivery; in the event of withdrawal, the 7-day case must be returned.
5. Pause, Skip, Reschedule
In your customer account you can skip individual deliveries, reschedule the next delivery date or pause the subscription.
6. Price Changes
We may change the price for future deliveries by email with at least 4 weeks’ notice. In this case you may cancel until the change takes effect. If you do not cancel, the new price applies from the announced delivery.
7. Right of Withdrawal
You have the statutory right of withdrawal. For subscriptions, the 14-day withdrawal period begins on the day you receive the first delivery. Details can be found in the withdrawal policy at www.viraxe.com/policies/refund-policy.
8. Satisfaction Guarantee
The voluntary Satisfaction Guarantee applies to the first delivery of your subscription: 90 days from receipt on the 90-day plan, 30 days from receipt on the 30-day plan (details in our Terms and Conditions, § 7). If you claim it, we refund the full price of the first delivery – regardless of how much you have consumed and without a return – and the subscription ends. Subsequent deliveries already shipped and billed are not refunded.
9. Cancellation by Us
We may cancel the subscription with 4 weeks’ notice to the end of a delivery cycle, in particular if the product is no longer available. Services already paid for but not delivered will be refunded.
